The law of weapons in Florida governs the sale, possession, and use of firearms and ammunition in the state of Florida in the United States.

Florida is a "must issue" state, and confidential issues carry permits for residents and non-residents. Florida recognizes licenses from any other country that recognizes the Florida license, provided that the non-resident individual is a resident of the other state and is at least 21 years of age or may be under 21 if the applicant is a member or veteran of the United States Armed Forces.

Preemption

Florida law prohibits locality from setting firearms, other than in relation to zoning laws (that is, to restrict where arms sellers can find their business) and as governed by the Florida Constitution in terms of arranging the sale by its non-licensed seller in public forums. The Florida legislature since 1987 has occupied all areas of firearms and ammunition regulations, including purchase, sale, transfer, taxation, manufacturing, ownership, ownership, and transportation. Due to the lack of penalties associated with violating preemption laws, it was almost universally ignored by city and county authorities until, on December 7, 2010, Representative Matt Gaetz introduced a bill to the Florida Legislature adding penalties for violating existing preemption laws. Open take it

Open carry when walking in public areas is generally illegal, but permitted under certain circumstances, as defined by Florida law 790.25 (3). For example, open carry is permitted when hunting, fishing, camping, gun shows, or while photographing, and when going to and from such activities. An open prohibition law was challenged in court but the ban was enforced.

The gun must be "securely closed" -F.S.S.790.25 (3) (l) Some cite this as a gray area or risky- or not immediately available for use. "Wrapped safely" means in a drawer, locked or not; snapped at sheath; in the box of weapons, locked or not; in case of zipper guns; or in a closed box or container that requires a cover or cover to be opened for access. Bringing a Pistol to a person in a vehicle without permission is not permitted (except in case the carry is open in accordance with the laws outlined above). On July 1, 2008, Florida became the country "Take your gun to work" (F.S. 790.251). This law prohibits most businesses from firing employees for holding firearms locked in their vehicles in the company's parking lot. The purpose of this new law is to enable citizens to exercise their Second Amendment rights during the round trip to and from work. Exceptions are listed in F.S. 790.251 (7) includes school properties, correctional facilities, nuclear power plants, national defense facilities, facilities for explosives or flammable materials, or motor vehicles owned, rented, or leased by one's employer.

A case was filed against Walt Disney World Resort by a dismissed former Disney security guard, despite having a CWL, having possession of a firearm locked in his car on July 1, violated the policy of not allowing pre-existing weapons from Disney. The case was later canceled by the plaintiff for personal and financial reasons. Disney claims that they are exempt from the new state law, on the basis that they have a firework license to perform a nightly firework show at Disney World.

Castle Doctrine and "Stand in your place"

The "Castle Doctrine" refers to a generally accepted common-law principle that one is not required to retreat while in his own place of residence. Eliminating the requirements for retreat outside the home (eg in public) is generally referred to as the law "on your side". On October 1, 2005, Florida became the "No Duty to Back Off" (ie Stand on Your Land). The Law of Florida Fortress Doctrine stipulates that law-abiding citizens and visitors can legitimately assume the threat of physical danger or death from anyone who intrudes into a residence or occupied vehicle and may use defense forces, including lethal force, against intruders. A person who uses force within the legal parameters is immune from criminal or civil proceedings and can not be arrested unless law enforcement agencies determine there is a possible cause that the force used is against the law. If civil action is taken and the court decides that the defendant is immune from the law, the defendant will be given all defense fees.

Firearm sales

Buyers must be at least 21 years of age to purchase firearms in Florida. There is a waiting period that is longer than 3 working days or until the background check is clear unless the buyer has a concealed carry permit, is a different firearm trade, the purchase is for rifle or rifle and the buyer has completed the 16 hr class security hunters besides holding the safety certification card hunter, or buyer are law enforcement or military.

As state laws on waiting periods and background checks do not apply to sales by non-licensed sellers, the Florida Constitution, Art VIII Sec. 5 (b), allows the area to enforce ordinances requiring the examination of criminal history records and a 3-day waiting period 5 for non-licensed sellers when any part of the sale of firearms is exercised on property that has "public" access rights, exhibits of weapons conducted on public property.The procedure of this local choice may not apply to licensed hidden weapons, only the Miami-Dade, Broward, Palm Beach, Hillsborough, and Volusia regions have enforced such rules.
