Overview

The Virginia Constitution protects the right of the people to guard and carry arms from government offenses. The Commonwealth of Virginia precedes local regulations of some aspects of firearms, although some local regulations are explicitly permitted. Virginia passed the Uniform Machine Rifle Act, compiled by the National Conference of Commissioners on Uniform State Law. The only prohibited firearms in Virginia are the Armsel Striker, also known as Striker 12, a similar rifle, and a "plastic gun". Firearms must contain at least 3.7 ounces of metal that can be detected electromagnetically in a barrel, slide, cylinder, frame or receiver, and when worn by an x-ray machine, produces images that accurately describe the shape. For example, Glock pistols that have polymer frames and metal slides and barrels are legal. There is no limit on the capacity of magazines, except that hidden pistol licenses (CHP) are required to carry magazines with more than 20 rounds in some urban public areas.

Forbidden places include courthouses, aircraft terminals, schools, the Capitol building and the General Assembly (open only, members of the General Assembly and those with valid CHP permitted in the Capitol General Assembly building), and churches, although some exceptions apply, including the opinions of the Attorney Agung 2011 that personal protection is a good reason and enough to be brought to church. George Mason University, Virginia Commonwealth University, and Virginia Polytechnic University (Virginia Tech) currently have rules that prohibit firearms at school properties.

Opinion 2006 issued by State Attorney Robert F. McDonnell states "... Virginia college and university councils may not enforce a general ban on carrying concealed weapons by permitted individuals... Based on specific grants of the statute of authority, however , it is my opinion that colleges and universities can regulate the behavior of students and employees to prohibit them from carrying hidden weapons on campus. "

In 2011, the Virginia Supreme Court found that the language used by George Mason University (GMU) for "... does not impose a total ban on weapons on campus, but the rules are adjusted, restricting weapons only in places where people gather and most vulnerable - in campus buildings and on campus events.Individuals may still carry or possess weapons on GMU open land, and elsewhere on campus not mentioned in the rules. "

There is a age limit of gun ownership and some people are prohibited from possessing firearms due to certain criminal convictions. A licensed dealer must have Virginia State Police conduct a background check before completing a certain firearm sale. People who are not in the business of selling firearms, but occasionally making personal sales, do not need to conduct background checks before selling their firearms. Prior to July 1, 2012, one can not buy more than one pistol per 30-day period, although some exceptions are applied; most significant, the holder of a valid Hidden Weapon Permit (CHP) from Virginia is exempt from this restriction. The bill that repealed the "one-hand-per-month" law was signed into law by Governor Bob McDonnell on February 28 that year.

Being open with a gun without permission is legal in Virginia at the age of 18, withholding other applicable laws. The undisclosed grip of a pistol is allowed for people holding the applicable CHP (concealed gun clearance), obey certain limits, or who hold certain positions. Virginia will issue CHPs for applicants aged 21 years and over, provided they meet certain safety training requirements and have no disqualification of criminal convictions. Consuming alcoholic beverages at ABC licensed restaurants and clubs on the premises, carrying a hidden pistol, is prohibited; nor should anyone carry a pistol hidden in a public place while under the influence of alcohol or illegal drugs. Any person permitted to carry a concealed firearm should not carry such a thing in a public place while drunk. Ownership of firearms may increase penalties for other violations, including possession of illegal drugs. Carry open while intoxicated is not discussed in law and may be considered legitimate unless otherwise specified.

There are some restrictions on the use of weapons. Brandishing guns can be punished up to one year in jail.
